The Supreme Court on Wednesday adjourned for a week the hearing on the bail plea of Umar Khalid, accused in the Delhi riots case.
New Delhi, January 24, 2024: A bench of Justices Bela M. Trivedi and Ujjal Bhuyan said they were available only till lunch and senior advocate CU Singh, appearing for Khalid, had also expressed his desire to pursue the matter.
However, the bench had cases listed for the special bench after lunch, so it adjourned the matter till January 31.
The matter last came up for hearing on January 10, when both the parties requested for adjournment due to their engagements as lawyers.
While posting the case for Wednesday, the court had said that no further adjournment would be given in this case.
Umar Khalid was arrested by Delhi Police on September 13, 2020, in the Delhi riots case and has been in jail since then.
Apart from seeking bail, he has also challenged the validity of Section 43D of UAPA.
This provision places stringent conditions for granting bail, requiring the judge to conclude that the charges against the accused are “prima facie true” based on the material presented by the prosecution.
During the hearing on January 31, the court will hear Khalid’s bail plea and will also consider other petitions challenging the validity of Section 43D of the UAPA.
