Supreme Court stays Allahabad HC order on survey of Shahi Eidgah Mosque
The Supreme Court on Tuesday stayed the Allahabad High Court order for survey of the Shahi Idgah Mosque in Mathura. The top court said that the matter is already pending in the Supreme Court, hence the order of Allahabad High Court will not be applicable.
The Supreme Court gave this order while hearing the petition of the Mosque Committee. The mosque committee had challenged the order of the Allahabad High Court.
The Allahabad High Court had ordered a survey of the Shahi Idgah Mosque in Mathura on December 14, 2022. The High Court had said that the survey should be conducted to find out whether there is any Hindu mandir below the mosque.
The top court has said that this matter is already pending in the Supreme Court. Hearing is going on in several cases of Shri Krishna Janmabhoomi-Shahi Idgah Mosque dispute in the Supreme Court. A survey of Shahi Idgah Mosque is also included in these matters.
The top court has said that the order of the Allahabad High Court will not be implemented. The Supreme Court will soon hear the petition of the Mosque Committee.
Explanation of Supreme Court’s decision
This decision of the Supreme Court means that the survey of Shahi Idgah Mosque in Mathura will not be done at present. This decision is important for both the parties.
This decision is a matter of relief for the mosque committee. The committee had filed a petition against the survey because the committee believed that the survey could increase communal tension.
On the other hand, this decision is disappointing for the Hindu side. The Hindu side believed that the survey would prove that the Shahi Idgah Mosque was built on the site of a Hindu temple.
After this decision of the Supreme Court, now both the parties will have to present their arguments in the apex court. The decision of the apex court is expected to finally resolve this dispute.
