In response to the highly charged debate surrounding the recent rape and murder of a 31-year-old doctor in Kolkata, Chief Justice of India DY Chandrachud urged the Centre and West Bengal governments to avoid politicizing the case. His remarks came during a contentious Supreme Court hearing involving Solicitor General Tushar Mehta and West Bengal’s counsel, Kapil Sibal.
Sibal had called for measures to prevent inflammatory statements, prompting Mehta to highlight a controversial remark by a West Bengal minister, suggesting severe consequences for anyone speaking against political leaders. Sibal countered by citing a statement from the Leader of the Opposition, which included threats of violence.
The Chief Justice intervened, urging both sides to refrain from political rhetoric and focus on the judicial process. He emphasized that the legal system is addressing the situation and that investigations are proceeding swiftly and effectively.
This case has sparked widespread protests, with the BJP criticizing the ruling Trinamool Congress, which in turn accuses the BJP of spreading false information to damage the state’s reputation. The Supreme Court bench, including Justices JB Pardiwala and Manoj Misra, expressed concern for the safety and well-being of doctors and vowed to issue enforceable directives.
Amidst the protests, doctors have raised concerns about retaliation for their participation, prompting the Chief Justice to remind them of their duty to patients. He stressed that the legal system would address any issues post-return to work and underscored the importance of maintaining medical services for those in need.
The court has established a National Task Force to enhance working conditions and safety for healthcare professionals, addressing long-standing issues in the sector.
