Criminal Contempt Action Sought Against Advocate Kishore

Advocate Rakesh Kishore faces potential criminal contempt proceedings after attempting to throw a shoe at Chief Justice of India (CJI) BR Gavai during Supreme Court proceedings on Monday. A petition seeking action has been submitted to the Attorney General of India, R Venkataramani.

Petition Filed for Criminal Contempt

Supreme Court lawyer Subhash Chandran KR wrote to the Attorney General requesting consent to initiate criminal contempt proceedings under Section 15 of the Contempt of Courts Act, 1971. The petition notes that Kishore’s act of hurling a shoe and shouting slogans constitutes gross interference with the administration of justice and undermines the dignity of the Supreme Court.

Behaviour Post-Incident

The petition highlights that Kishore made further contemptuous remarks against the Chief Justice in media interactions, expressing no remorse and justifying his actions. The petition contends that such conduct demonstrates an attempt to scandalise the court and erode public confidence in the judiciary.

Details of the Incident

The incident occurred in Courtroom No. 1 of the Supreme Court during the morning session. Security personnel quickly intervened and restrained Kishore as he shouted, “Sanatan ka apman nahi sahega Hindustan” (Hindustan will not tolerate insults to Sanatan Dharma) while being escorted out. The Bar Council of India subsequently suspended him for conduct deemed unbecoming of an advocate. Delhi Police did not pursue further action after the Supreme Court Registrar General declined to file a case.

Related Petitions

Another petition has been filed seeking contempt proceedings against religious orator Aniruddhacharya, also known as Aniruddh Ram Tiwari, and YouTuber Ajeet Bharti for allegedly inciting the attack through provocative remarks.

National Condemnation

The attempted attack drew widespread condemnation. Prime Minister Narendra Modi, Opposition Leader Rahul Gandhi, Congress President Mallikarjun Kharge, and Chief Ministers including MK Stalin, Pinarayi Vijayan, Siddaramaiah, Revanth Reddy, and Mamata Banerjee condemned the act. The Supreme Court Bar Association, the Supreme Court Advocates-on-Record Association, and various High Court bar associations also expressed solidarity with the CJI and denounced the act.
