The Ministry of Electronics and Information Technology (MeitY) has released an advisory to social media platforms, urging swift action against hoax bomb threats. These platforms are directed to remove such hoaxes promptly, report any threats, and cooperate fully with authorities to ensure public safety.
Timely Assistance in Investigations: Under IT Rules 2021, platforms are required to assist authorized government agencies in investigations and cybersecurity matters within a maximum of 72 hours.
The Ministry highlighted the serious risk hoax bomb threats pose to public order and national security, especially concerning airlines. Such threats not only cause public alarm but also disrupt economic stability, affecting a large population and airline operations. The viral spread of these threats is exacerbated by features like forwarding and reposting on social media, amplifying misinformation and endangering airline security.
Under the IT Act and Rules, social media platforms must exercise due diligence by preventing users from hosting, sharing, or transmitting unlawful or false content that could compromise public order. Failure to comply with these responsibilities may revoke intermediaries’ protection under Section 79, making them liable under the IT Act and the Bharatiya Nyaya Sanhita (BNS), 2023.
Prompt Removal of Misinformation: Social media platforms must remove or disable access to misinformation, including hoax bomb threats, within strict timeframes.
Reporting under Bharatiya Nagarik Suraksha Sanhita, 2023: Platforms are required to report any activity threatening India’s unity, integrity, security, or economy.
Cooperation with Authorities: Intermediaries must provide relevant information and assist government agencies promptly, within a maximum of 72 hours, to support investigations and cybersecurity efforts.
