SC Seeks Centre’s Reply on Bias Against Bengali Speakers

The Supreme Court on Friday directed the Union government to clarify whether Bengali-speaking individuals are being disproportionately targeted and suspected as foreigners. The observation came during a hearing on a petition that claimed migrant labourers from West Bengal were being detained in various states on the assumption that they were Bangladeshi nationals.

A bench comprising Justices Surya Kant, Joymalya Bagchi, and Vipul M Pancholi acknowledged that India faces genuine challenges of illegal infiltration. However, the judges sought clarity on whether the use of “a particular language” is being treated as presumptive evidence of foreign origin by law enforcement agencies.

The Petition and Its Concerns

The plea before the apex court sought intervention to prevent arbitrary detention of Bengali-speaking workers. Petitioners argued that migrant labourers from West Bengal, who travel across the country in search of livelihood, face harassment and wrongful confinement merely because of the language they speak.

According to the petition, such practices violate the fundamental rights to equality and liberty guaranteed under the Constitution. It urged the judiciary to restrain authorities from treating Bengali language as an automatic indicator of Bangladeshi identity.

Court’s Observations

During the hearing, Justice Bagchi noted that while illegal immigration from Bangladesh remains a long-standing concern, it cannot justify blanket suspicion against citizens of India. “Language cannot be the sole determinant of nationality,” the bench remarked.

The judges asked the Centre to respond to whether any official instructions, formal or informal, existed directing enforcement agencies to presume that Bengali speakers may be foreigners. The bench underlined the need for a balanced approach that secures borders without endangering the rights of legitimate citizens.

Centre’s Response Awaited

The Union government has been asked to file its reply in the coming weeks. The clarification is expected to detail existing procedures for verifying citizenship and the safeguards in place to prevent misuse of authority against linguistic minorities.

The case assumes significance in light of recurring debates around the National Register of Citizens (NRC) and the Citizenship Amendment Act (CAA). While these measures aim to address infiltration and illegal stay, they have also triggered concerns of profiling based on ethnicity and language.

Impact on Migrant Workers

Migrant labourers from West Bengal form a substantial part of India’s workforce, particularly in construction, domestic services, and small-scale industries. Many of them travel to states such as Karnataka, Maharashtra, and Kerala for employment. Rights activists argue that unwarranted suspicion not only exposes them to harassment but also disrupts their livelihood.

Civil society groups have called for more transparent verification processes and training of enforcement officials to avoid linguistic bias. They stress that citizenship checks must rely on valid documents and not stereotypes about language or appearance.

Broader Context

The Supreme Court has in the past played a crucial role in balancing the government’s duty to secure national borders with its responsibility to uphold fundamental rights. The present petition adds to ongoing conversations about inclusivity and the protection of migrant workers within India.

Observers believe the Centre’s reply will set an important precedent, potentially influencing how states handle cases of suspected foreign nationals in the future. The matter has been listed for further hearing after the government files its response.
