Wife’s Uncle Granted Pre-Arrest Bail in Techie Atul Subhash Suicide Case

The Allahabad High Court on Monday granted anticipatory bail to Sushil Singhania, the uncle of Nikita Singhania, in connection with the suicide case of AI engineer Atul Subhash. The order was issued by Justice Ashutosh Srivastava while hearing the anticipatory bail plea filed on behalf of Sushil Singhania.

Atul’s wife, Nikita Singhania, was earlier arrested from Gurugram, Haryana, alongside her mother, Nisha Singhania, and brother, Anurag Singhania, who were detained in Prayagraj, Uttar Pradesh. They were taken into custody for allegedly abetting Atul’s suicide. The Bengaluru Police confirmed the arrests and said the trio had been brought to Bengaluru and remanded to 14-day judicial custody by a local court.

Senior advocate Manish Tiwary, representing the applicant, argued that Sushil Singhania’s arrest was based solely on a suicide note and a viral video. He emphasized that the 69-year-old applicant suffers from chronic health conditions and is incapable of any direct involvement in abetting the suicide. Tiwary also contended that the accusations in the suicide note, at most, amounted to harassment and not abetment, as defined under the law.

The defense further sought protection for Sushil Singhania, arguing that granting bail would allow him to present his side of the story before the Karnataka court, where the FIR was registered.

After reviewing the case, the court granted anticipatory bail to Sushil Singhania, citing his age and health conditions. Justice Srivastava directed that if arrested, the applicant should be released on bail upon furnishing a personal bond of ₹50,000 and two sureties of the same amount. The bail will remain effective until the police file a report under Section 173(2) of the CrPC.

The court also imposed several conditions on the applicant, including cooperating with the investigation, refraining from tampering with evidence, and not leaving India without prior court approval. Additionally, Singhania was instructed to surrender his passport to the concerned authorities.

This decision comes amid heightened public and media scrutiny surrounding the high-profile case, which has drawn significant attention due to allegations of harassment and financial exploitation of the deceased.
