NHRC Takes Suo Motu Cognizance of Gurugram Minor Assault Case

The National Human Rights Commission (NHRC), India, has taken suo motu cognizance of a disturbing incident involving the alleged sexual assault and torture of five minors in Gurugram, Haryana. The children were reportedly held captive for nearly 18 hours in the DLF Phase 3 area on suspicion of theft. The Commission has issued a notice to the Gurugram Police Commissioner seeking a detailed report within two weeks.

Allegations of Captivity and Abuse

According to media reports dated February 5, 2026, the five children, aged between 11 and 14 years, were allegedly detained at an under-construction building. The contractor and four workers reportedly suspected the children of attempting to steal construction materials.

The minors were allegedly stripped, assaulted, and subjected to physical torture during their confinement. Reports further claim that petrol was poured over them, intensifying the gravity of the alleged crime. The situation reportedly continued for several hours before the matter came to light.

Humiliation of Family Members

The alleged incident also involved the mothers of the children. When they reached the location in search of their children, they were reportedly forced to sit alongside them and subjected to humiliation. The incident was brought to official notice after one of the mothers approached the police on February 3, 2026, to lodge a complaint.

NHRC’s Observations

Taking serious note of the reported events, the NHRC observed that if the allegations are found to be true, they represent a grave violation of the human rights of minor children. The Commission has directed the Commissioner of Police, Gurugram, to submit a comprehensive report detailing the investigation status and action taken.

The NHRC’s intervention underscores its mandate to safeguard constitutional rights and ensure accountability in cases involving vulnerable groups, especially children.

Legal and Child Protection Framework

India’s legal framework provides stringent safeguards for children against abuse and exploitation under the Protection of Children from Sexual Offences (POCSO) Act and other criminal provisions. The Haryana Police is expected to conduct a thorough investigation in line with these statutory protections.

Authorities have not yet released detailed findings publicly. However, officials have indicated that necessary legal procedures are being followed. Updates are expected once the police submit their report to the Commission.

Call for Swift Justice

The alleged incident has triggered public concern over the safety of children and the need for strict enforcement of child protection laws. Rights advocates emphasize that accountability and timely action are critical to restoring faith in the justice system.

As the investigation progresses, the focus remains on ensuring justice for the victims and preventing similar incidents in the future. The NHRC’s directive is expected to expedite administrative scrutiny and legal proceedings in the case.
